Werdet nicht zu Totengräber*innen!
Diesen Apell richten wir gemeinsam mit anderen Organisationen an die Bundesregierung und das Europäische Parlament. Am 20. Juni, dem Weltflüchtlingstag, forderten wir mit einem Trauermarsch vom Bundesinnenministerium zum Bundestag die politisch Verantwortlichen auf, das Recht auf Asyl nicht zu Grabe zu tragen. Vor dem Bundestag haben wir außerdem den hunderten Toten des Schiffsunglücks vor Pylos gedacht – eine direkte Folge der EU-Abschottungspolitik. Diese Katastrophe macht uns deutlich, dass wir weiter gegen die GEAS-Reform protestieren müssen: Sie wird zu noch mehr Leid und Tod führen!

Guten Tag mein Name ist Bruno Watara, ich spreche für die Kampagne BLEIBERECHT FÜR ALLE – statt Chancenfalle!
Wir haben heute schon viel über die Pläne der EU und der deutschen Regierung gehört. Ich will das nicht alles wiederholen. Wir als Flüchtlinge, hören vor allem einen Satz aus diesen Plänen heraus: Flüchtlinge haben keine Rechte.
Es war auch bisher so, dass viele Asylverfahren unfair waren. Aber wir hatten Asylverfahren und konnten die Entscheidungen des BAMF von einem Gericht überprüfen lassen. In Zukunft sollen viele Flüchtlinge nur noch Grenzverfahren statt Asylverfahren bekommen und während dem Grenzverfahren inhaftiert werden. Und dann ohne eine richtiges Asylverfahren abgeschoben werden. In das Land aus dem sie gekommen sind, egal, was sie dort erlebt haben.
In den letzten Tagen haben mich manchmal Asylsuchende gefragt, was das eigentlich für die bedeutet, die schon in Deutschland sind. Das kann jetzt noch niemand genau wissen. Aber eine Gefahr ist klar: Diese Grenzverfahren basieren auf einer gefährlichen Lüge – Sie behaupten einfach, die Schutzsuchenden sind noch nicht eingereist, sind noch nicht in Europa, sondern im Transitbereich – wie auf einem Flughafen. Auf derselben Lüge basieren auch die sogenannten Flughafenverfahren in Deutschland. Auch dort finden vor der Einreise Schnellverfahren mit eingeschränktem Rechtsschutz statt.
Und bitte denkt nicht, dieser Betrug, diese Idee von einem Transitbereich, der außerhalb der Gesetze eines Landes existiert, kann nur an den Außengrenzen sein. Es geschieht immer wieder, dass Regierungen auch Orte auf eindeutig nationalem Gebiet zum Transitbereich erklären – was zum Beispiel nach deutschem Recht einen Rechtsbruch darstellt.
Unsere Kampagne BLEIBERECHT FÜR ALLE – statt Chancenfalle! gibt es seit letztem Jahr. Wir beobachten und kritisieren die Politik der Bundesregierung im Umgang mit Flüchtlingen.
Im Koalitionsvertrag von SPD, BÜNDNIS 90/DIE GRÜNEN und FDP hat die Bundesregierung versprochen, die Situation von Asylsuchenden und Migrant*innen zu verbessern. Geplant waren viele Gesetzesänderungen in insgesamt vier Gesetzespaketen, den sogenannten “Migrationspaketen”.
Mit dem ersten Migrationspaket wurde das sogenannte Chancen-Aufenthaltsrecht eingeführt. Dieses Wort hat vielen Flüchtlingen Hoffnung gemacht. Wir haben gedacht endlich haben wir eine Chance. Aber schon das war eine Lüge. Viele Geduldete haben weiterhin keine Chance, weil das Gesetz kleinliche und diskriminierende Ausschlussgründe beinhaltet.
Die Regierung hat uns aber noch mehr versprochen: Zum Beispiel die Duldung light und Arbeitsverbote abzuschaffen. Von diesen geplanten Gesetzesänderungen hören wir seit Monaten nichts.
Stattdessen kommt es noch schlimmer. Stattdessen kommt altbekannter Rassismus mit Plänen für noch mehr Abschottung und schnelleren Abschiebungen zurück.
Das kenne ich schon lange. Seit 2014 kam eine Asylrechtsverschärfung nach der anderen. Ich kann mich kaum erinnern wie oft wir auf der Straße protestiert haben.
Das macht uns wütend. Wir müssen um Sozialleistungen betteln und uns mit dem Asylbewerberleistungsgesetz quälen lassen. Wir dürfen nicht arbeiten, wir dürfen uns nicht frei bewegen. Wir dürfen kein Leben in Sicherheit mit unseren Familien planen. Man verbietet uns zu leben. Man behandelt uns wie Tiere.
Das macht uns krank und traumatisiert uns. Und das macht viele von uns verrückt. Das deutsche Asylsystem bringt uns langsam um.
Gleichzeit beobachten wir, dass Flüchtlinge mit ukrainischem Pass all die Rechte haben, um die wir kämpfen müssen. Es ist richtig, dass sie diese Rechte haben. Aber diese Rechte stehen allen Flüchtlingen zu.
Es reicht. Wann endlich werden europäische Politiker*innen und europäische Regierungen alle! Flüchtlinge wie Menschen behandeln. Wann endlich werden sie auch unsere Menschenrechte achten? Menschenrechte stehen uns allen zu!

Don’t become administrators of death!
Together with other organisations, we are addressing this appeal to the German government and the European Parliament. On 20 June, World Refugee Day, we held a funeral march from the Federal Ministry of the Interior to the Bundestag, calling on the political leaders not to bury the right to asylum. In front of the Bundestag, we also commemorated the hundreds of people who died in the shipwreck off Pylos – a direct consequence of the EU’s policy of sealing people off. This catastrophe makes it clear to us that we must continue to protest against the GEAS reform: it will lead to even more suffering and death!

We have already heard a lot about the plans of the EU and the German government. I don’t want to repeat it all. Above all, we as refugees notice one sentence from these plans: Refugees have no rights.
Asylum procedures have already been unfair before. But asylum procedures existed and we were able to have the decisions of the BAMF reviewed by a court. In the future, many refugees shall only receive procedures at the EU border instead of asylum procedures in the countries and they shall be imprisoned during the procedure at the border. And then be deported without a proper asylum procedure. To the country they came from, no matter what they experienced there.
Recent day, asylum seekers have sometimes asked me what this actually means for those who are already in Germany. No one can know for sure yet. But one threat is clear: these “Grenzverfahren” (border procedures) are based on a dangerous lie. They simply claim that the asylum seekers have not yet entered, are not yet in Europe, but in the transit area – similar to an airport. The so-called “Flughafenverfahren” (airport procedures) in Germany are also based on the same lie. Accelareated procedures with limited legal protection happen there before entry.
And please, do not think that this fraud, this idea of a transit area that exists outside the laws of a country, can only be at the external borders. It happens again and again that governments also declare places on clearly national territory to be transit areas – which, for example, under German law constitutes a violation of the law.
Our campaign BLEIBERECHT FÜR ALLE – statt Chancenfalle! exists since last year. We observe and criticize the refugee policies of the Federal Government.
In the coalition agreement of SPD, BÜNDNIS 90/DIE GRÜNEN and FDP, the Federal Government has promised to improve the situation of asylum seekers and migrants. Many legislative changes were planned in a total of four legislative packages, the so-called “Migrationspakete” (migration packages).
With the first “Migrationspaket”, the so-called” Chancen-Aufenthaltsrecht” was introduced. This word has given hope to many refugees. We thought we finally would have a chance. But that was a lie. Many tolerated persons still have no chance because the law contains mean and discriminatory exclusion criterions.
But the government promised even more: for example, to abolish “Duldung Light” and work bans. We haven’t heard about these planned legislative amendments since months.
Instead, it gets worse. Instead, old-fashioned racism comes back with plans for even more isolation and faster deportations.
I’ve known that for a long time. Since 2014, asylum rights have been tightened more and more. I can hardly remember how many times we protested on the street.
That makes us angry. We must beg for social benefits and be tormented by the “Asylbewerberleistungsgesetz”. We are not allowed to work, we are not allowed to move freely. We are not allowed to plan a life with our families under safe conditions. We are forbidden to live. We are treated like animals.
It sickens and traumatizes us. And that drives many of us crazy. The German asylum system is slowly killing us.
At the same time, we observe that refugees with Ukrainian passports have all the rights we have to fight for. It is right that they have these rights. These rights have to be available to all refugees.
When will European politicians and European governments finally treat all(!) refugees like human beings? When will they finally respect our human rights too?
Human rights belong to all of us!
